Ride Away with 100K


BY REGISTERING FOR AND ENTERING IN THIS CONTEST, YOU FULLY AND UNCONDITIONALLY AGREE TO COMPLY WITH ALL OF THE TERMS AND CONDITIONS BELOW.

  1. BINDING AGREEMENT: In order to enter the “Ride Away With 100k “the (Contest), you must agree to these Official Contest Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and SponsorBarn.com with respect to the Contest.
  2. ELIGIBILITY: The Contest is only available and open to legal residents of the fifty (50) United States and the District of Columbia, who are located in the United States at the time of entry and are of the legal age of majority in their state of residence at the time of entry and are a register member of SponsorBarn.com in “active” standing. The following are not eligible: employees, contractors, directors and officers of SponsorBarn.com LLC (the “Sponsor”), its parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfillment, legal, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, “Contest Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in their same households of each such employee, contractor or other person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest).
  3. TO ENTER:  To enter the Contest, log on to www.sponsorbarn.com (“Web Site”) during the Contest period. Follow on-screen directions to properly complete and submit a member registration form. For your registration to be valid, you must complete all required information in the four-step member registration process. To be automatically entered into the Contest you must register for a Preferred or higher membership.  All entrants must have a valid e-mail address.  A valid e-mail will be sent to the e-mail address provided.  Entrants must validate membership by following the membership validation procedures.
  4. TERM. The Contest begins at 0:00:01 Central Standard Time ("CST") on September 1, 2009 and ends at 23:59:59 CST on May 1, 2010 (the "Contest Period"). Sponsor's clock is the official time keeping device for this Contest. Sponsor reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Contest and these rules, for any reason, at any time without notice, and without liability. Complete Contest dates will be posted on the Site. Any changes in dates will be communicated on the Site.
  5. PRIZES: 1st place -  a sponsorship contract of approximately $50,000 in value; 2nd place – a sponsorship contract of approximately $25,000 in value; 3rd place – a sponsorship contract of approximately $15,000 in value; 4th place - a sponsorship contract of approximately $10,000 in value.
  6. SPONSOR:  This Contest is sponsored by SponsorBarn.com LLC, a Delaware corporation with a principal place of business at 2618 Thomas Ave, Dallas, TX  75204.
  7. CONTEST BONUS CRITERIA:   Each entrant can earn additional Bonus Entries to increase the odds of winning.  Bonus Entry – is the equivalent to one additional entry into the contest. 
    1. Completed Profile:  Each member that has a full and complete profile will earn one additional Bonus Entry.
    2. Early Entry:  Members will receive a Bonus Entry for each month they are active prior to contest drawing.
    3. Blog Entries:  Members that reach a total greater than 15 blog journals will receive one Bonus Entry.
    4. Promotional Pictures:  Members that send in pictures of themselves wearing or promoting SponsorBarn.com or the Contest will receive a Bonus Entry
    5. Affiliate Program:  Members that participate in a SponsorBarn.com affiliate program, either athlete program or website affiliate program will receive a Bonus Entry.
  8. SELECTION OF WINNER:  Potential Winners will be drawn within thirty (30)days after the contest period ends.  Potential winners will be notified initially by telephone or to e-mail address provided on the Website during the member registration process or thereafter changed as provide herein. Once contacted, Potential Winners will be sent a Potential Winner Packet to include “acceptance terms” and “sponsorship contract” via certified mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release/Acceptance, and, where lawful, a Publicity Release within seven (7) days of attempted notification or prizes may be forfeited. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prizes. Unclaimed prizes will not be awarded. All Potential Winners must be an “active” member of SponsorBarn.com throughout Contest period, and at the time the Potential Winners are selected.  All Potential Winners are subject to verification, including without limitation, verification of eligibility, compliance with these Rules and completion and acceptance of release forms. In addition, Sponsor reserves the right to require a confidential background check upon the Potential Winner selection to help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor or Contest Parties into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest or Sponsor, as determined by Sponsor in its sole discretion, and that the awarding of the prize to the Potential Winner will not violate applicable U.S. laws or regulations. In addition, Sponsor reserves the right to require the Potential Winner to submit the information necessary for the confidential background check and authorize the check through electronic means designated by Sponsor and its service providers, in order to expedite the process of verifying the Potential Winner as eligible to receive Prizes. If Potential Winner has been convicted of a felony or a misdemeanor of moral turpitude or has filed a petition in bankruptcy within the previous ten (10) years, or Potential Winner fails to submit the information for the background check and authorize the check electronically where instructed to do so by Sponsor, or Sponsor determines in its sole discretion that use of the Potential Winner in advertising might reflect unfavorably on the Sponsor or that the awarding of the prize may violate applicable U.S. laws or regulations, the Sponsor may disqualify the Potential Winner. If attempted notification is returned as undeliverable, if a Potential Winner is not verified as eligible or cleared via the background check, or if a Potential Winner is otherwise ineligible to receive Prizes, Prizes will be forfeited and may be awarded to an alternate Potential Winner in Sponsor’s sole discretion. Entrants agree that the Sponsor has the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsor are final and binding. Status as a Potential Winner is confidential and if selected as a Potential Winner you may not disclose Potential Winner status to any other person prior to the official announcement of the designated Contest Winner. In the event that Potential Winner status is disclosed to any other person prior to the announcement of the Winner by Sponsor, you may forfeit your status as a Potential Winner and forfeit the prize. Odds of winning are determined by number of entries including “Bonus Entries”.
  9. SPONSORSHIP CONTRACT OFFER / TERMS OF ACCEPTANCE:  Winners will receive a “terms of acceptance” and a “sponsorship” contract for the 2010 year  Winner will be required to participate in marketing and promotions of the “Ride Away with 100K” winner program, SponsorBarn.com, its parent, subsidiaries Contest Parties  and any other companies associated with the Contest for the 2010 year and in agreement with the Sponsorship contract and as an independent contractor.
  10. GENERAL CONDITIONS: Winners are solely responsible for any taxes on the Prizes, and will receive an IRS Form 1099 for value of the Prizes. By participating, entrants agree to these Rules and Sponsor’s Web Site Terms and Conditions, and privacy and security statement (available at www.sponsorbarn.com) which are final and binding in all respects. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Contest. A minimum 2,000 preferred  member entries are required to hold this Contest, if less than the minimum members Prizes may be pro-rated or substituted, or not provided at the sole discretion of Sponsor, 
  11. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor or Contest Parties resulting from any User's participation in or attempt to participate in the Contest or download of any information in connection with participating in the Contest. No responsibility or liability is assumed by the Sponsor or Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestions on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an account used in connection with the Contest. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Rules, or any inaccurate or incorrect data contained on the Web Site. Use of the Web Site is at the User’s own risk. Sponsor and the Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to any User's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, the entrant thereby releases Sponsor and Contest Parties from any and all claims, damages or liabilities arising from or relating to such entrant’s entry or in the Contest. By accepting a Prize in the Contest, Winners agree that the Sponsor and Contest Parties shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize, or any travel related thereto.
  12. TAX CONSIDERATIONS: Winner is solely responsible for any local, state, federal or any other applicable taxes, and any other costs, expenses and fees connected with the prize. Entrant must provide tax related documentation as requested by the Sponsor to meet its tax reporting obligations.
  13. CHOICE OF LAW: This Contest and any action related thereto shall be governed, controlled, interpreted and defined by and under the laws of the State of Texas and the United States, without regard to the conflicts of laws provisions thereof. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms and Conditions shall be the state courts of the State of Texas for the County of Dallas or the United States District Court for the Northern District of Texas and each of the parties hereto submits itself to the exclusive jurisdiction and venue of such courts for the purpose of any such action. Any and all claims, judgments, and awards against sponsors or Contest Parties shall be limited to actual out-of-pocket costs incurred by the Entrant, including costs associated with participating in this Contest, but in no event attorneys' fees. Entrants hereby waive all rights to (I) claim or be awarded any punitive, direct, indirect, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and (ii) to have damages multiplied or otherwise increased, including for willful patent infringement.
  14. WINNER LIST:  A request for the winners list can be requested ninety (90) days after completion of contest by sending a self address envelope to: SponsorBarn.com LLC, 2618 Thomas Ave, Dallas TX  75204.
  15. BASIC MEMBER ENTRY:  No purchase necessary.  To participate as a basic member please send a 3x5 card with your name, address, phone number, e-mail, site username and date of membership origination to 2618 Thomas Ave, Dallas TX  75204 Attention “Ride Away with 100K”..
  16. WARRANTY AND INDEMNITY: To the maximum extent permitted by law, each Participant indemnifies and agrees to keep indemnified SponsorBarn.com LLC its affiliates and their respective directors, office, employees and agents, at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each Participant agrees to defend, indemnify and hold harmless SponsorBarn.com LLC, its affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (a) any material uploaded or otherwise provided by the Participant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the Participant in connection with the Contest; (c) any non-compliance by the Participant with these Official Rules; and (d) claims brought by persons or entities other than the parties to these Official Rules arising from or related to the Participants involvement with the Contest. To the extent permitted by law, Participant agrees to hold SponsorBarn.com LLC, its respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Contest and/or use or acceptance of any prize.
